1. About Us

Wildtrak Leisure Australia 62 009 438 153, trading as Wildtrak (“Wildtrak”, “we”, “us”, “our”).

2. Scope

These Terms apply to your access to our website(s), mobile site(s) and online services (collectively, “Sites”) and to any purchase of products from us online or otherwise (collectively, “Products”). By using the Sites or purchasing Products, you agree to these Terms.

3. Australian Consumer Law (ACL)

Nothing in these Terms limits your rights under the Australian Consumer Law (ACL). Our Products come with guarantees that cannot be excluded under the ACL. You are entitled to a repair, replacement or refund for a major failure. For minor failures, you are entitled to a repair or replacement within a reasonable time. See Returns below for how to make a claim.

4. Orders & Acceptance

4.1 Placing an order constitutes an offer to buy Products. We may accept or reject any order, including for unavailability, error in price or description, or suspected fraud.

4.2 Order acceptance occurs when we dispatch the Products and send you a dispatch confirmation.

4.3 You must be at least 18 and provide accurate contact, delivery and payment details.

5. Pricing, Payment & Promotions

5.1 Prices are in Australian dollars and include GST unless stated.

5.2 We use reasonable care to ensure pricing and availability are accurate, however errors may occur. If we discover an error after you order, we will contact you to confirm, cancel or refund.

5.3 We may run promotions, coupons or “online only/special order” offers subject to additional terms. Promotions cannot be used in conjunction with other offers unless stated.

6. Delivery & Risk

6.1 Delivery times are estimates only. We are not liable for delays outside our reasonable control.

6.2 Risk in the Products passes on delivery to your nominated address or collection by you/your carrier. Title passes once full payment is received.

6.3 You must inspect the Products on delivery and notify us of transit damage within a reasonable time.

6.4 Orders are usually dispatched within 1–2 business days; however, during peak times dispatch may be delayed.

7. Returns, Change of Mind & Warranty

7.1 Consumer guarantees (ACL) apply as described in clause 3.

7.2 Change of mind: We may, at our discretion, offer returns or exchanges for change of mind within 30 days of delivery, provided the item is unused, in original packaging with proof of purchase. Some items (e.g., clearance, hygiene-sensitive products, customised items) may be excluded where permitted by law. Change-of-mind returns do not affect your ACL rights.

7.3 Warranty: Many Products carry a manufacturer’s warranty in addition to ACL rights. Warranty periods and processes vary by brand; see the product page or included documentation.

7.4 How to make a claim: Contact us at sales@wildtrak.com.au with order details, a description of the issue and photos (if applicable). We will advise next steps (assessment, repair, replacement or refund). For major failures, you may choose a refund or replacement. For minor failures, we will repair or replace within a reasonable time.

7.5 Return shipping: Where the Product is faulty or misdescribed, we cover reasonable return costs. For change-of-mind returns, you are responsible for return freight.

8. Product Information

8.1 Images and descriptions are for general guidance; colours, dimensions and weights are approximate.

8.2 We may correct errors or update information at any time. If a correction materially affects your order, we will offer options to proceed or cancel for a refund.

9. Acceptable Use of the Sites

You must not misuse the Sites, including by interfering with security, introducing malware, scraping, or using automated means to access the Sites without permission.

10. Intellectual Property

All content on the Sites (including text, images, logos, graphics and software) is owned by or licensed to Wildtrak. You may not reproduce, modify or distribute content without our prior written consent, except as permitted by law for personal use.

11. User Content (Reviews)

If you submit reviews, photos or other content, you grant Wildtrak a non-exclusive, royalty-free, transferable licence to use, reproduce and display that content on the Sites and our marketing channels. You warrant you own the content and it does not infringe third-party rights or applicable law.

12. Third-Party Services

We may provide links to third-party sites or use third-party services (e.g., payment gateways, couriers, analytics). We are not responsible for third-party content or practices. Your use of those services is subject to their terms and privacy policies.

13. Liability

13.1 To the extent permitted by law and excluding liability under the ACL, we exclude all warranties and conditions (express or implied) regarding the Sites and Products.

13.2 Except for liability that cannot be limited under the ACL, our maximum aggregate liability to you for any loss arising out of or in connection with the Sites or a purchase is the price paid for the relevant Products.

13.3 We are not liable for indirect, incidental or consequential loss (including loss of profit, opportunity or data) except where not permitted by law.

14. Force Majeure

We are not responsible for delay or failure to perform due to events beyond our reasonable control (e.g., extreme weather, carrier disruption, pandemic-related restrictions).

15. Privacy

We handle personal information in accordance with our Privacy Policy. By using the Sites or purchasing Products, you agree to that policy.

16. Changes to These Terms

We may update these Terms from time to time. The version posted on the Sites at the time of your order applies to that order. For material changes to website terms, we will post a notice on the Sites.

17. Governing Law & Disputes

These Terms are governed by the laws of Queensland, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia.
